By accessing or using Abitso (“the Service”), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service. We reserve the right to update these terms at any time; continued use after changes constitutes acceptance.
2. Description of Service
Abitso provides an accountability platform that connects users with accountability partners, enables goal tracking, and optionally allows users to put “skin in the game” through stakes. The Service is provided as-is and we do not guarantee uninterrupted or error-free operation.
3. Account and Eligibility
You must be at least 18 years old and capable of forming a binding contract to use the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You must provide accurate and complete information when registering.
4. User Conduct
You agree not to use the Service to harass, abuse, or harm others; to violate any applicable laws; to impersonate any person or entity; or to interfere with the Service’s operation. We reserve the right to suspend or terminate accounts that violate these terms or our community guidelines.
5. Stakes and Financial Terms
If you use stakes or any paid features, additional terms and payment policies apply. Stakes are subject to verification and may be forfeited according to the rules you agree to when setting a goal. Refunds are governed by our separate refund policy.
6. Intellectual Property
The Service, including its design, branding, and content (except user-generated content), is owned by Abitso Inc. or its licensors. You may not copy, modify, or create derivative works without our written permission. You retain ownership of content you submit but grant us a license to use it to operate the Service.
7. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. WE DO NOT GUARANTEE THAT THE SERVICE WILL MEET YOUR REQUIREMENTS OR THAT ACCOUNTABILITY PARTNERSHIPS OR STAKES WILL ACHIEVE ANY PARTICULAR OUTCOME.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ABITSO INC. AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR DATA, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM.
9. Termination
We may suspend or terminate your access to the Service at any time, with or without cause. You may close your account at any time. Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive will survive (e.g., disclaimers, limitation of liability).
10. Governing Law and Disputes
These terms are governed by the laws of the United States and the State of Delaware, without regard to conflict of law principles. Any disputes shall be resolved in the courts located in Delaware, and you consent to personal jurisdiction there.
